Victim’s son was target of ongoing drug investigation

FOLEY, Ala. — A 77-year-old Foley man was shot and killed by police Wednesday morning after he shot a Foley officer during the execution of a search warrant at the victim’s house.
Robert Woods of 2500 E. Ashford Dr. was killed after opening fire on the Special Response Team that was attempting to search the house for drugs that were allegedly being sold by Michael Woods, 51, the victim’s son who lived at the residence.
Referring to Michael Woods, Foley Police Chief David Wilson said during a 11:30 a.m. press conference Wednesday in the Foley Municipal Courtroom that Foley undercover officers had purchased drugs from the subject before; that Michael Woods had told undercover officers as late as the night before that he had a “large amount of marijuana.”
Wilson said the blame for the shooting death needed to be placed where it belonged, namely, on Michael Woods.
“His daddy got killed today because he (Michael Woods) sold drugs out of that house.”
As for Robert Woods’ thinking at the time he opened fire on police, Wilson said, “What was on his mind, nobody knows this side of heaven.”
On Friday, in connection with the search warrant and Michael Woods, Foley police announced the arrest on Wednesday night of Calvin Lowell Kimmerle, 46, of East Ashford Park Drive , or as Wilson put it “four doors down” from the house where the search warrant was served on Michael Woods.
Kimmerle’s arrest came on a distribution warrant resulting from undercover narcotics purchases from Kimmerle and Michael Woods in the latter part of April, according to Lt. David White, lead investigator at Foley Police Department.
On Wednesday, stressing the preliminary nature of the investigation at that point regarding Michael Woods and the shooting of Robert Woods, Wilson said Foley officers attempted to execute the search warrant at approximately 6 a.m. Officers conducted a “knock and announce” and entered the residence yelling “police” and “search warrant” repeatedly and loud.
At that point, Michael Woods was taken into custody and a female resident, identified as Michael Woods’ mother, was detained, Wilson said. At some point, Robert Woods emerged from the master bedroom with a handgun that Wilson said had “laser sights engaged.”
More than one officer yelled for Robert Woods to drop the gun, but he fired and struck veteran Foley police officer Randy Stallworth, Wilson said. A “pretty serious gunshot wound to the upper thigh” is the way Wilson described Stallworth’s injury.
“They were afraid they’d be shot at again,” Wilson said of Foley officers. He said those officers saw the red dot produced by the laser sight at times on them or coming at them.
At that point, several officers returned fire, killing Robert Woods in the process, Wilson said.
The officers involved in the shooting are on paid administrative leave pending the results of an investigation into the incident, according to Wilson, who put the number of officers at four. He also said those officers will be undergoing counseling as part of post-shooting procedure.
“They did exactly as they have been trained to do,” Wilson said of the officers’ conduct as it related to the shooting incident.
Wilson said authorities have no reason to believe that Robert Woods had a criminal past or knew about the drugs allegedly in his house. The chief said the shooting incident took precedent over the search for drugs.
Michael Woods was charged on two felony counts of distribution of marijuana, and Wilson said additional charges could be added depending on the outcome of the search of the house. At week’s end, Foley police said an amount of marijuana was found in the house and Michael Woods was charged with felony possession of marijuana and possession of drug paraphernalia as well. Also on Friday, Wilson said two undercover officers had actually been sold drugs from inside the home where Michael Woods was living with his parents.
Wilson described Michael Woods during Wednesday’s press conference as being “very volatile on the scene.” He also said, according to neighbors, that Michael Woods’ parents were “about to boot him out” of the house.
Stallworth was airlifted to Baptist Hospital in Pensacola following the shooting. He was undergoing surgery Friday morning to remove the bullet and is expected to make a full recovery. In comments Friday, Wilson said he had spent time with Stallworth’s parents, who are relieved that their son’s injury proved not to be life threatening.
The Alabama Bureau of Investigation will be the lead agency to look into the shooting incident, according to Wilson. ABI will be assisted by the Baldwin County Sheriff’s Office and Baldwin County District Attorney’s Office.
Michael Woods was booked into the Baldwin County Corrections Center on Thursday morning and remained in the facility as of Friday morning.
