I just received an email from the Minnesota Rifle & Revolver Asso. President.

The MN Dept of Revenue has just assessed about $19,000.00 in back Sales Tax (2004, 05 & 06), penalties and fines to Minnetonka Game and Fish Club. This is not a rumor. I just got off the phone with their President. MN Dept of Revenue has determined that gun clubs are considered the same as Athletic Facilities, Recreational Areas, Resorts and Campgrounds as outlined on Sales Tax Fact Sheet 123. Department of Revenue considers all of the following subject to th 6.5% Sales Tax: Annual Dues and one time fees Match Fees Trap Fees Deer Hunter Sight In fees event admissions.
I have attached a copy of the Sales Tax Fact Sheet. Please forward this to you clubs Board. Thank you,

Can anyone explain to me how a non-profit can be exempt from income tax but not sales tax?

Because a non-profit is exempt from income tax but not sales tax. There are too many taxes to be exempt from them all.
Now, let it sink in... feel the anger... let it fester... Yay! another person sees how greedy our government is.
Sales tax on range time, seems pretty lame though.

Is this a change in policy? Has the position of the Department of Revenue always been that sales tax was due, or is this new?
Have the other gun clubs been charging sales tax?

It's whether "tangible personal property" is involved, according o the statute. But, the Dept. of Revenue interprets the law.
But the Dept of Revenue has all kinds of guidelines including some not on the website. I couldn't find anything on "club dues", but they might have a booklet on it.
I've seen coorespondence invloving a kid's lawn care and snow shoveling business. One is service actually taxable and the other is not. A "competitor' turned him in and it was audited.
